He wants to end it through Congress, not threw the courts. This is the, egh, third time its been struck down by the courts since Obama's been in the office and every time he's appealed. He says its his duty to uphold the law, which it is, until Congress decides it shouldn't be law anymore.

He was a Constitutional Law professor, so unless he somehow decides that the don't ask don't tell rule isn't actually unconstitutional, I doubt he'll try to appeal it.

It should also be noted that under Obama, the DOJ has not only appealed repeals of DADT, but I believe it is also appealing the recent repeal of sections of DOMA. The appeals have absolutely nothing to do with the constitutionality and everything to do with politics. By taking the "sorry, the DOJ has to defend everything" approach, Obama is passing the buck for the blame. This also falls in line with his continued failure to take a leadership role with regard to LGBT rights. Even on those acts currently in Congress, such as the repeal of DADT and passing an Employment Non-Discrimination Act, Obama has done practically nothing after requesting them in his State of the Union. It's appalling that both of those are stalled in a Congress where the Democrats control both houses.

It should also be noted that the current Republican governor of California, Arnold Schwarzenegger, and the Democratic attorney general, Jerry Brown, are refusing to defend Proposition 8 in court. I find it hilarious that that a Republican governor is showing more leadership on LGBT rights than our Democratic president.

I will be voting for people like Jerry Brown (who is running for CA governor) and Barbara Boxer (who is running for CA senate) because they take are taking energetic, active leadership roles on these issues. It is looking very likely like I will be abstaining with regard to the presidential vote come 2012.

This is why it is wonderful to live in a country like Canada where our head of state is non-partisan (the Queen) and our government cannot over-rule constitutional decisions of the Supreme Court without invoking a not-withstanding-clause which has never been done and would most certainly invoke civil war (because the clause can void any section of our charter of rights and freedoms) hahaha When our courts told the government to change it's ways within 6 months regarding same sex marriage...it was done, written in stone and laid to rest. Parliament did have a final vote though to pass it, which was more of a formality.

Actually, not surprising at all. Arnold is married to Maria Shriver who is from the Kennedy family...long time Democratic roots there! Even though Arnie says he's Republican, I bet he feels the heat at home from his wife and family-in-law ;)

I wonder if any of these presidents take into consideration that a large number of voter might be Lesbians and Gays. Or do they just convienently forget that after they take their vows of office? We need to have a Gay/Lesbian president yet. At least the country will be ran alot more beautifully. And the civil rights of our people (gays) will be finally acknowledged. I, as a rule, am not interested in politics. But, I support my brothers/sisters in this matter.

Love live the fairies/dykes. After all we secretly run this country. Art, service realated, fashion. etc.... Without us the models would be wearing gunny sacks.

Today, the Department of Justice made a filing in a legal challenge to the Don’t Ask, Don’t tell (DADT) policy, as it traditionally does when acts of Congress are challenged. This filing in no way diminishes the President’s firm commitment to achieve a legislative repeal of DADT – indeed, it clearly shows why Congress must act to end this misguided policy. The President was disappointed earlier this week when a majority of the Senate was willing to proceed with National Defense Authorization Act, but political posturing created a 60 vote threshold. The President spoke out against DADT in his first State of the Union Address, and the Secretary of Defense and the Chairman of the Joint Chiefs have both testified in support of repeal. And the Department of Defense continues to work on a plan on how to implement repeal. The President, along with his Administration, will continue to work with the Senate Leadership to achieve a legislative repeal of DADT as outlined in the NDAA this fall.

I love how that statement from Gibbs can be boiled down to this:

"Indeed, it clearly shows why Congress must act to end this misguided policy, because we can't be bothered or deal with the responsibility to do it ourselves."

Obama has not one, but two, was to end DADT. As chief of the executive branch of the government he can order the Department of Justice to not appeal. As commander-in-chief of the military, he can order them to cease enforcement. This is so infuriating, I cannot see how at this point I will not be abstaining from voting for a president come 2012.
